Dear Orbit Clients -

By now you’ve probably heard about CCPA, California Consumer Privacy Act. We want to suggest that your organization review the regulations and determine how they apply to you.

The following information is not legal advice nor should it be considered legal advice. This information is meant to help you better understand CCPA.

Your Website’s Data and User Privacy (GDPR and CCPA)

What is CCPA (California Consumer Privacy Act)?

A personal data protection law passed by the State of California as a response to the increased role of personal data in contemporary business practices and the personal privacy implications surrounding the collection, use, and protection of personal information.

How could CCPA impact your business?

  • Talk to your attorney if any of these apply:
    • Does your website collect data of California residents?
(i.e., Ecommerce orders, webforms, blog comments, cookies, etc.)
    • Does your business exceed any of the following thresholds?
      • Annual gross revenues of at least $25 million
      • Obtains personal information of at least 50,000 California residents, households, and/or devices per year
      • At least 50% of your annual revenue is generated from selling California residents’ personal information

What is GDPR (General Data Protection Regulation)?

A legal framework that sets guidelines for the collection and processing of personal information from individuals who live in the European Union (EU). Regulation applies regardless of where websites are based and all sites that attract European visitors, even if they don't specifically market goods or services to EU residents.

How could CCPA impact your business?

  • Talk to your attorney if any of these apply:
    • Does your website receive traffic from UK visitors?
    • Does your website collect data of UK residents?
(i.e., Ecommerce, webforms, blog comments, cookies, etc.)
    • Does your business operate in the UK?
